Blockchain Association and Crypto Council File for Expedited Scheduling Order in Challenge to Digital Asset Tax Act
Washington, D.C. (October 13, 2026) – Today, the Blockchain Association (BA), Crypto Council for Innovation (CCI), together with the State of Illinois, the Digital Chamber (TDC), and the Illinois Blockchain Association (IBA) filed a joint motion in the Circuit Court of Sangamon County asking the Court to enter an expedited scheduling order in the associations' two pending challenges to the State’s Digital Asset Tax Act.
The State has agreed to an injunction staying the effectiveness and enforcement of the Digital Asset Tax Act until July 1, 2027.
To reach a decision on the tax’s lawfulness as quickly as possible, the parties proposed an expedited summary judgment briefing schedule, with opening motions due November 4, 2026, and briefing complete by January 22, 2027. The parties also asked the Court to hold a hearing between February 8 and February 19, 2027. BA, CCI, TDC, and IBA requested a decision by March 1, 2027, and the State does not oppose that request. The schedule is subject to the Court's approval.
“Illinois consumers and businesses deserve to know whether this tax is lawful before they are asked to comply with it. The agreement to pause enforcement provides that protection until July 1, and the expedited schedule puts the question before the Court quickly. We brought this challenge because a tax that singles out digital assets for different treatment violates federal and Illinois law and would set a troubling precedent and cause unfair damage to the digital asset industry. We look forward to making our case on the merits,” said Summer Mersinger, Chief Executive Officer, Blockchain Association.
“While pausing enforcement of the Digital Asset Tax Act protects Illinois consumers and businesses from this onerous and legally flawed tax until July 1, it remains imperative that the merits are determined as soon as possible. No one should have to rebuild their operations or fear criminal penalties based on an unconstitutional and unlawful tax that unfairly singles out digital assets. We will make our case on an expedited timeline, and continue to vigorously defend our industry until the court holds this tax unlawful,” said Ji Hun Kim, Chief Executive Officer, Crypto Council for Innovation.
